MARGO’S LOW IMPACT HEALTH CLUB
MEMBERSHIP AGREEMENT
Business Name: BARSCHY LLC DBA Margo’s Low Impact Health Club
Location: Freehold, New Jersey
THIS IS A LEGALLY BINDING AGREEMENT. PLEASE READ CAREFULLY.
1. AGREEMENT
This Membership Agreement is entered into between the undersigned Member and BARSCHY LLC DBA Margo’s Low Impact Health Club, hereafter referred to as “Margo’s” or “Studio.”
By purchasing a membership, attending a class, or authorizing payment, Member agrees to all terms set forth herein.
2. MEMBERSHIP OPTIONS
Margo’s offers the following membership types:
Unlimited Monthly – 6 Month Term Commitment
Unlimited Monthly – Month to Month
Limited Monthly
Class Packs
Drop In Sessions
Specific pricing, start date, and rate are selected at time of purchase and are incorporated into this Agreement.
3. TERM
A. 6 Month Membership
The 6 Month Membership is a fixed term agreement beginning on the selected start date and continuing for six consecutive billing cycles.
This is a binding financial commitment for the full six month term.
B. Month to Month Membership
Month to Month memberships renew automatically each billing cycle until properly cancelled in accordance with Section 6.
4. BILLING AND PAYMENT AUTHORIZATION
Member authorizes Margo’s to charge the payment method on file for all recurring membership fees, failed payment fees, early termination balances, and any other amounts owed under this Agreement.
Member agrees to maintain valid and current billing information at all times.
If payment fails:
Member will be notified.
Member has 5 calendar days to cure the failed payment.
Access to classes may be suspended until payment is resolved.
Returned payments may incur a $25 administrative fee.
5. AUTO RENEWAL
All recurring memberships automatically renew unless properly cancelled in writing pursuant to Section 6.
Member understands that recurring billing will continue until written cancellation is confirmed.
6. CANCELLATION
All cancellations must be submitted in writing via email to admin@my-margos.com
or delivered in writing at the studio.
A written confirmation will be issued within 3 business days. If confirmation is not received, cancellation is not valid.
Cancellations take effect at the end of the current billing cycle, provided all outstanding amounts are paid.
7. EARLY TERMINATION – 6 MONTH MEMBERSHIP
The 6 Month Membership reflects a discounted rate in exchange for a full term commitment.
If Member elects to terminate before completion of the six month term, Member agrees to immediately pay the full remaining contract balance.
Remaining balance is calculated as:
Monthly Rate × Number of Months Remaining
Example:
If Monthly Rate is $279 and 3 months remain, total buy out is $837.
There is no additional penalty fee. The remaining balance is due in full at the time of early termination request.
Failure to pay the remaining balance constitutes breach of contract and may result in collections action.
Non attendance, injury, illness, pregnancy, relocation, scheduling conflicts, dissatisfaction, or financial hardship do not release Member from contractual responsibility.
8. FREEZE POLICY
Members may request one freeze per 6 month period for up to 30 consecutive days for medical, travel, or hardship reasons.
Request must be submitted in writing 14 days in advance.
Documentation may be required.
Freeze time extends the contract term by the number of frozen days.
Freeze approval is at the sole discretion of the Studio.
9. NO REFUNDS
All payments are final and non refundable, including unused classes or partial months, except where required by New Jersey law or in the event of permanent studio closure.
10. MEMBER CONDUCT
Member agrees to:
Follow instructor guidance
Disclose medical conditions, pregnancy, or injuries
Use equipment safely
Maintain respectful conduct
Margo’s reserves the right to suspend or terminate membership without refund for unsafe behavior, harassment, or violation of studio policies.
11. ASSUMPTION OF RISK
Member acknowledges that participation in fitness activities involves inherent risks.
Liability is governed by the signed Client Liability Waiver, which is incorporated by reference into this Agreement.
12. DEFAULT AND COLLECTION
If Member defaults on payment obligations:
Studio may charge the payment method on file
Studio may suspend access
Studio may refer unpaid balances to a third party collection agency
Member agrees to pay reasonable collection costs and attorney fees permitted by law.
13. POLICY CHANGES
Margo’s may update pricing or policies with 30 days written notice.
Existing 6 Month Members remain bound by their agreed rate for the duration of their term.
14. GOVERNING LAW AND VENUE
This Agreement is governed by the laws of the State of New Jersey.
Any dispute shall be brought exclusively in the state courts located in Monmouth County, New Jersey.
15. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
16. ENTIRE AGREEMENT
This Agreement, together with the Client Liability Waiver, constitutes the entire agreement between Member and Studio and supersedes all prior representations or agreements.
17. ELECTRONIC SIGNATURE
Member agrees that electronic acceptance or digital signature has the same legal effect as a handwritten signature.
FINANCIAL COMMITMENT DISCLOSURE
BY PURCHASING THE 6-MONTH UNLIMITED MEMBERSHIP, YOU ACKNOWLEDGE THAT A 6 MONTH MEMBERSHIP IS A BINDING FINANCIAL COMMITMENT FOR THE FULL TERM SELECTED. YOU ARE RESPONSIBLE FOR PAYMENT OF THE ENTIRE 6 MONTH BALANCE REGARDLESS OF ATTENDANCE, INJURY, ILLNESS, PREGNANCY, RELOCATION, OR ANY OTHER PERSONAL CIRCUMSTANCE. EARLY TERMINATION REQUIRES PAYMENT OF THE FULL REMAINING CONTRACT BALANCE AS SET FORTH IN SECTION 7.
